Timor Quarry Appeal

The Upper Hunter Shire Council announced at its meeting last night that verbal advice has been received that the Newcastle and Hunter Valley Speleological Society have lodged a Class 1 Appeal against Council's decision last month to approve the Timor Limestone Quarry.
Council approved the above application at its June Council meeting subject to a number of conditions. The application was for designated development as defined in the Environmental Planning and Assessment Act which provides further opportunity for those who make a submission in respect of an application to lodge an appeal to the Land and Environment Court.
Mayor Michael Johnsen has advised that the Council does not yet know what specifically the appeal is focussing on and Council will need to consider its position once the exact nature of the appeal is known.
"Council has been through a rigorous process with this development and sought advice from Government agencies in addition to any information provided in the environmental impact statement, community submissions and specialist consultant's reports.
"The community's concerns provided council with valuable feedback which then resulted in specific mitigation measures in the conditions of consent.
"As a result, council is very confident the decision to approve the development was in the best interests of the community", Mayor Johnsen said.
A copy of the details lodged with the Land and Environment Court on 24/7/09 have not, at the time of preparing the report, been received.
